Bayer faced with pharmaceutical litigation over antibiotic Avelox

Antibiotics can be life-saving in cases of severe infection. However, sometimes the potential risks associated with specific drugs necessitate a more sparing approach, calling for their use only as a last resort. As a growing number of cases of pharmaceutical litigation seems to indicate, a class of antibiotics known as fluoroquinolones could be among them, and residents of Ohio may wish to familiarize themselves with the possible risk of negative side effects.

In one recent case, for example, a consumer has filed a lawsuit against the manufacturers of the drug Avelox, a fluoroquinolone antibiotic. The defendants in the lawsuit include Bayer Healthcare Pharmaceuticals Inc., Bayer AG, Bayer Corporation, Bayer Pharma AG, and Merck & Co. Inc. His complaint cites fraud, liability and product liability, negligence, failure to warn and breach of implied warranty.

The lawsuit, filed May 9, alleges that the defendants manufactured and sold to consumers a drug that is defective. The plaintiff states that he suffered physical injury from taking the prescription medication. The defendants should be held legally responsible, the man claims, because they failed to adequately warn him of the potential harmful side effects associated with taking the drug.

The injured man is requesting a trial by jury. He seeks damages including general, special, compensatory, consequential and punitive, as well as medical expenses, a full refund of purchase costs, interest, court costs and further relief as deemed appropriate by the court.
